Freedom of Information Request

The Freedom of Information Act relates to recorded information held by public bodies, including schools. It aims to provide a balance between greater openness, whilst recognising the need to restrict disclosure where it would cause harm or would not be in the public interest.

Schools and other organisations such as multi-academy trusts make information routinely available through what is known as the ‘publication scheme’. The Information Commissioner’s Office (ICO) has approved a Model Publication Scheme, which North West Academies Trust has adopted.

The Trust has produce a guide to identify what information is published, the available format, how it can be accessed and also any fees that may be chargeable for information.

Before making a request for information you may want to see if the information you require is already published on our website, or under ‘Acknowledged FOI Requests’ at the bottom of this page.

Where information is not already available through the publication scheme, the Freedom of Information Act allows members of the public to request information in writing. If we cannot disclose the information you have asked for we will tell you what exemption(s) apply and why we think they are applicable.

    What information can I request?
  • Under the Freedom of Information Act you can request access to some recorded information held by The Trust.

    The Freedom of Information Act is not intended as a way to obtain information that is routinely available, or for general enquiries, advice or guidance. Please check our website to see whether the information you want to see is already available; or if you have a general enquiry, please click on the link at the top of this page to use our contact form.

    How do I make a Freedom of Information request?
  • You can make a Freedom of Information (FOI) request through the Contact Us section of this website, or in writing to: North West Academies Trust, Union Street, Chester, CH1 1QP.

    Your request should include your name and an address for our response (this can be an e-mail address). Please specify clearly what information you would like to access.

    Unfortunately, you cannot make an FOI request over the telephone.

    When will I receive the information I have asked for?
  • Once we have received your request, and if we hold the information requested and there is no reason why we are unable to comply with your request (e.g. an exemption is engaged), we will send you the information within 20 working days (excluding school and public holidays), as required under the Freedom of Information Act.

    How to Complain
  • If you are dissatisfied with our response or the way your request has been dealt with, you can contact North West Academies Trust to request a review.

    If you are still dissatisfied, you may ask the ICO to consider your complaint. Please click on the link below for further information on how you can request the ICO to investigate your complaint. Please note that you must first exhaust your right of appeal through the academy review procedure before approaching the ICO. Refer to website: http://www.ico.org.uk/complaints for more information.

Subject Access Request

A subject access request, or SAR, is a written request to a company or organisation asking for access to the personal information it holds on you.

This is a legal right everyone in the UK has, that you can exercise at any point for free in most circumstances.

    Your right to make a subject access request
  • Under GDPR, you can make a subject access request for free.
    This right of access allows you to be aware of the processing of your personal data. For example, you might want to make a subject access request if you’re not convinced the company is processing your data lawfully.
    You might also want to ask about any logic involved in any automated decisions made about you or get confirmation that your data is being processed and request access.
    GDPR gives you the right not to be subject to a decision based solely on automated processing if it affects you legally or substantively.

    What will happen to your request?
  • We will reply to you without delay and at the latest within one month, starting from the day we receive the SAR.
    If the request is complex, or are numerous, a further two months may be necessary, but you will be informed within one month of the receipt of the request, with an explanation of why an extension is necessary.
    The SAR is free of charge but a ‘reasonable fee’ will be applied when a request is manifestly unfounded or excessive, particularly if it is repetitive.

    When will information be withheld?
  • Example's of when it would be appropriate to withold information are:
    If the information could identify someone else, and it would not be reasonable to disclose that information to you.
    If you are being investigated for a crime, or in connection with taxes, and the investigation would be prejudiced if you had access to the information.
